If you are obliged to observe the ElektroG as a manufacturer, seller or importer, you can have the recycled electrical devices offset against your pick-up duty, thereby cutting costs. To do this, you need to report to stiftung ear the amount of end-of-life equipment that you have disposed of. This can be done in just the same way as you report back for a pick-up request. Retail take-back obligation according to the ElektroG
As a high-street retailer, online retailer, mail-order retailer or craftsman bringing electronic products to the German market and in addition having a sales or storage area of at least 400 m² for electronic products, you are obliged under Germany’s Waste Electrical and Electronic Equipment Act (ElektroG) to take back end-of-life appliances.
This retail take-back obligation means that you are required to take back end-of-life electrical and electronic equipment from consumers at no charge and to ensure that it is disposed of professionally. We can assist you in meeting this legal obligation.
Germany-wide collection and disposal of electronic devices from municipal collection facilities
If you are obliged to observe the ElektroG as a manufacturer, seller or importer of electronic products, you must also ensure that end-of-life and faulty electronic and electrical equipment collected at municipal facilities is disposed of in an environmentally friendly way (responsibility for product).
Legal background: Germany’s Waste Electrical and Electronic Equipment Act (ElektroG)
The Batteries Act came into force in Germany on 1st December 2009. It transposes European Directive 2006/66/EC into national law and governs the „sale, return and environmentally sound disposal of batteries and accumulators“. The aim of the BattG is to increase the percentage of batteries that are returned, because they contain not only valuable raw materials but also substances that are hazardous to the environment and to health. The Act requires manufacturers, distributors or importers of batteries to contribute to the cost of disposing of the batteries (responsibility for product or responsibility for taking back and disposing of batteries). For this purpose, the Joint Battery Returns System (GRS Batterien) was created and a register was set up at the Federal Environmental Agency.
