Austria: Amendment of battery legislation delayed
The amendment of battery legislation in Austria is being delayed and will not be ready by 18 August 2025. We have summarised the key considerations for producers in Austria at this time.
For producers registered for batteries in Austria, this now specifically means:

Until full implementation, the waste management regulations from EU Directive (EU) 2023/1542 apply directly, as well as the current Austrian Battery Directive BGBl. II No. 59/2008, as amended by BGBl. II No. 311/2021 in EU-compliant interpretation.

Existing registrations remain valid.
Upcoming changes:

In future, there will be five battery categories instead of three (portable batteries, light means of transport batteries (LMT batteries), starting, lighting and ignition batteries (SLI batteries), industrial batteries and electric vehicle batteries (EV batteries)).

As of autumn 2025, registrations in the EDM (electronic data management – environment) will be automatically adjusted:

Registrations for portable batteries will be extended to include LMT batteries.

Registrations for industrial batteries will be extended to include EV batteries.

Registrations for SLI batteries (starter batteries) remain unaffected.

If the new registrations do not apply to your company (e.g. because your company does not distribute LMT batteries on the Austrian market), the allocations must be actively corrected by your company or by your authorised representative (UFH).

As of 1st January 2026, batteries must be reported in accordance with the five new categories.
It is also planned that, once the Austrian Accompanying Law to the EU Battery Regulation comes into force, all producers of batteries (regardless of the battery category) will be required to participate in a collection and recovery system, including at least the reporting obligations.
